Man Sues Chinese Buffet for False Advertising, Claims "He did not get all he can eat"

A man from the Western NY area is suing a Chinese restaurant after the restaurant staff asked him to pay more to stay or leave. "Clearly, it is NOT an all you can eat restaurant!" the man says. "I come here quite often and I always pay and leave a good tip. I was very offended when the staff approached me and asked me to pay more or leave. I thought this was America!" Due to the pending lawsuit, the man's identity and the name of the restaurant are not being released.

The restaurant claims the man entered the restaurant when it opened around 11:30AM and was still eating around 3:30PM. At 3:30, the restaurant switches from it's lunch buffet to dinner buffet. The restaurant claims it wasn't unfair treatment and that all patrons that come in between the lunch and dinner buffet are made aware that if they take certain items they are charged the price for the dinner buffet instead of the lunch buffet. The restaurant staff claims that when the man was told he was going to be charged the dinner price if he stayed he became irate The price for lunch buffet is approximately $9 after tax while the dinner buffet is closer to $15 after tax.

The restaurant involved in the pending lawsuit offered this statement via voicemail:

"We not kick him out because he eat too much, we kick him out because he no want to pay extra for dinner. We tell him no shrimp and crab legs, they for dinner only. If he want to have crab leg and shrimp he pay more. He not like it and get mad. He say this America and it his freedom to eat whatever he wants. He not want to pay so we ask him to leave. He pay lunch price and leave. He come here all the time and he love to stay here long time."

Both parties involved are currently trying to settle this matter out of court.
