Medical marijuana bill introduced in West Virginia Senate

CHARLESTON, W.Va. Senate Bill 386 was introduced Tuesday to create the West Virginia Medical Cannabis Act.

The bill would set up a commission and a special revenue account for medical marijuana.

The West Virginia Cannabis Commission would license medical marijuana growers and set parameters for them.

Under the bill, Marshall University's Forensic Science Center as the primary testing laboratory.

A new criminal offense would be created for anyone distributing, possessing, manufacturing or using marijuana that has been diverted from an authorized medicinal use.

Senate Bill 386 would also give the governor the power to suspend the implementation of the act if he determines there is a reasonable chance of federal prosecution of state employees in regards to the bill.

People would have to undergo a national background check and pay all fees that have to do with the background check.

The bill will be referred to the Health and Human Resources Committee and then on to the Judiciary Committee.
