Minneapolis Family Suing former Metro Mobility driver for $100,000

In the spring of 2016, Damon Byrd, a 40 year old Brooklyn Park resident and former Metro Mobility Driver was charged with 3 felony counts and one gross misdemeanor of: Elder Abuse and Neglect, Distribution of Narcotics, Driving Under the Influence, and Reckless Driving.

The incident occurred while Byrd was driving a client to her nail appointment. The victim stated that when Byrd was assisting her onto the bus she noticed the driver was purfusly sweating and reeked of alcohol.

The victim stated while in route Byrd was dispatched about being behind on schedule. Due to this reason, Byrd didn't completely fasten the passenger in correctly; thus resulting in her being ejected from her seat. This then resulted in the passenger sustaining injuries to both her head, neck and lower back.

Byrd then immediately rushed to assist the victim and properly fasten the passenger back into her seat. While doing this the passenger stated that she was unable to move her neck and she was in severe pain. At this time Byrd was caught on video camera offering the passenger narcotic pain medication. Byrd had refused to bring the passenger to the hospital due to him being late for his lung break. Instead he proceeded in route to the nail shop.

The victim and her family are now filing a civil suit against Damon Byrd for $100,000 for elderly abuse and neglect. Byrd may also be facing a 5 year prison sentence if Hennepin County Sheriffs Office pick up the case.

Byrd was asked if any of the allegations were true and he stated that he is innocent on all counts. Byrd will appear in court on December 6, 2016.
