North Carolina has passed legislation in the House that officially bans E-Cigs, more commonly referred to as "Vapes" by anyone under the age of 21 years old. The Assembly was asked to review current legislation on the books to determine if a ban would violate rights granted by the "Cigarette Act of 1985" which lowered the legal smoking age to 10 years old. A revised version of the act in 2000 raised the legal age to smoke in North Carolina to 12 but Federal regulations deny smokers the ability to purchase tobacco products to 18 years of age.

The new regulations would make it a felony for anyone to purchase tobacco products for a person under 21 years old with a penalty of 5 years in prison. The new law also reduces the legal drinking age to 16 years old and the hope is that by allowing younger smokers to drink instead of smoke it will ease the burden of nicotine withdraw.
